It should be noted here that few months before this final decision from the Lusaka High Court, the judge announced that the case proceedings were closed and both parties were required to submit their evidences and testimonials in written form before the court. Based on these confirmations, the judge would announce the final judgement. It was a very positive announcement for Dr. Rajan Mahtani and his lawyers as most of his evidences and testimonials were sufficient enough to prove his legal shareholding over the factory.
However, the final decision shocked everyone as the Ventriglias were given majority shareholding as per this decision. As a result, Dr. Rajan Mahtani was left with no choice but to approach Court of Appeal. The Court of Appeal announced its final decision quickly, around nine months after the case was launched there. According to this decision, Dr. Rajan Mahtani is the majority shareholder of the Zambezi Portland Cement with 58 percent shares. On the other hand, Ventriglias are only minority shareholders without any legal ownership over the factory. Based on this decision which also aligns with original shareholding pattern established during 2007, it is clear that Dr. Rajan Mahtani is the legal owner of the factory.
