During these years, Dr. Mahtani and his team have submitted numerous documents and evidences to prove their claim. Some of the critical evidence submitted by Dr. Mahtani during these years included shareholder’s agreement signed by all parties associated with the cement factory, financial exhibits which clearly showed that Dr. Mahtani and his company Finsbury Investment has made millions of dollars worth of investment in the factory, much higher that other shareholders. One of the most critical evidence shared by Dr. Mahtani’s lawyers was the independent audit report conducted by an external and independent auditor. The report clearly indicated that the factory was established as a joint venture and Dr. Rajan Mahtani was the sole joint venture partner of the establishment. Therefore, it was clear and predictable win for Dr. Mahtani as his evidences and testimonials were much stronger than the respondents. The respondents on the other hand, failed to submit any significant evidence or testimonials during the trial years to prove their claims.
Therefore, when the judge made the final verdict which was given against Dr. Mahtani, it was clear that the shocking verdict was made by ignoring almost all of the evidences and the judge clearly made a misdirected judgement. Dr. Mahtani has now made an appeal to the higher court of appeal against this misdirected judgement.
